Terms of Service

1. Agreement
By accessing or using Cartiva ("Service"), operated at app.cartiva.io, cartiva.io, and mcp.cartiva.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Service Description
Cartiva is an analytics platform for agentic commerce. It provides e-commerce merchants with visibility into how AI shopping agents (such as ChatGPT, Gemini, Perplexity, and Copilot) interact with their online stores. The Service includes:
- An MCP proxy that captures AI agent discovery data (searches, product views, variant checks)
- A web dashboard for viewing analytics and agent behavior insights
- A WordPress/WooCommerce plugin for integration
- API endpoints for programmatic access to analytics data
3. Account Registration
- You must provide a valid email address to create an account
- You are responsible for maintaining the security of your account credentials and API keys
- You must not share API keys or allow unauthorized access to your account
- You must promptly notify us of any unauthorized use of your account
- One store URL per merchant account — duplicate store registrations are not permitted
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Interfere with or disrupt the Service or its infrastructure
- Exceed rate limits (100 req/s for webhooks, 60 req/min for API per session)
- Use the Service to collect, store, or process personal data in violation of applicable laws
- Resell, sublicense, or redistribute the Service without written permission
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy and Cookie Policy.
- You retain ownership of your store data and analytics
- We may use anonymized, aggregated data to improve the Service and produce industry reports
- We do not sell your data to third parties
- Upon account deletion, all your data is purged within 48 hours
6. MCP Proxy
The MCP proxy service forwards AI agent requests to your store and logs discovery metadata. By using the proxy:
- You acknowledge that agent requests pass through our infrastructure
- The proxy operates in read-only mode — it does not modify requests or responses
- We add less than 50ms of latency to proxied requests
- If the proxy is unavailable, requests fail through to your store directly
- You are responsible for configuring your store's MCP endpoint correctly
7. WordPress Plugin
The Cartiva WordPress plugin:
- Is provided under the GPL license (as required by WordPress.org)
- Collects agent metadata from orders and forwards it to the Cartiva API
- Requires a valid API key configured in WooCommerce Settings
- Can be deactivated at any time — deactivation removes webhooks but preserves settings
8. Service Availability
We strive for high availability but do not guarantee uninterrupted service. The Service is provided "as is" and "as available". We are not liable for downtime, data loss, or service interruptions. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.
9. Pricing and Payment
Cartiva currently offers a free tier during the MVP phase. Pricing plans (Starter, Pro, Enterprise) as displayed on our website represent intended future pricing and are subject to change. We will provide at least 30 days notice before introducing or changing pricing for existing users.
10. Intellectual Property
- The Service, including its code, design, and documentation, is our intellectual property
- You retain all rights to your store data and content
- The Cartiva name, logo, and branding are our trademarks
11. Limitation of Liability
To the maximum extent permitted by law, Cartiva shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
- You may terminate your account at any time via the Dashboard settings
- We may suspend or terminate accounts that violate these Terms
- Upon termination, your data is purged within 48 hours per our Privacy Policy
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or Dashboard notification at least 14 days before they take effect. Continued use after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the Republic of Poland. Any disputes shall be resolved in the courts of Warsaw, Poland.
